  User Agreements

. WireSpeed Telecommunications, LLC (WireSpeed) is a commercial organization dedicated to improving business, educational, and individual opportunities via the Voice and Data Communications and Networks

Users of the WireSpeed network will:

Remember that they are interacting on a Global network and act appropriately.
Avoid interfering with the work of other users.
Avoid disrupting the network host systems.
Avoid disrupting network services.

2. VIOLATIONS OF WIRESPEEDS'S ACCEPTABLE USE POLICY (AUP)

The following practices constitute violations of the AUP and will not be tolerated. Users found knowingly practicing them may, in the discretion of WireSpeed, lose their account with WireSpeed. Should WireSpeed believe that a criminal statute has been violated, it will immediately inform the proper authorities.

a. ILLEGAL USE. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations promulgated thereunder.

b. HARM TO MINORS. Using the Services to harm, or attempt to harm, minors in any way.

c. THREATS. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that threatens or encourages bodily harm or destruction of property.

d. HARRASSMENT. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that harasses another.

e. FRADULENT ACTIVITY. Using the Services to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes," and "chain letters." Deceptive on-line marketing practices are also considered fraudulent activities. The FTC will bring cases against these types of marketing schemes. For information about what the FTC has done against these types of schemes review the Deception Policy Statement from the FTC.

f. FORGERY OR IMPERSONATION. Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous re-mailers or nicknames does not constitute impersonation. Using deliberately misleading headers ("munging" headers) in news postings in order to avoid spam email address collectors is allowed.

g. UNSOLICITED COMMERCIAL EMAIL/UNSOLICITED BULK EMAIL. Using the Services to transmit any unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature, are prohibited.

h. UNAUTHORIZED ACCESS. Using the Services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of WireSpeed's or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption, theft or loss of data.

i. COPYRIGHT OR TRADEMARK INFRINGEMENT. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.

j. COLLECTION OF PERSONAL DATA. Using the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.

k. RESELLING THE SERVICES. Reselling the Services without WireSpeed's written authorization. No subscriber shall provide access to the WireSpeed network to any other person, or shall sell, resell, share, give, or provide, either separately or in conjunction with any other service or amenity, access to any of the services provided by WireSpeed.

l. NETWORK DISRUPTIONS AND UNFRIENDLY ACTIVITY. Using the Services for any activity which adversely affects the ability of other people or systems to use WireSpeed services or the Internet. This includes "denial of service" (DoS) attacks, viruses, Trojan horses, worms, and other types of malicious programs against another network host or individual user. Interference with or disruption of other network users, network services or network equipment is prohibited. It is the User's responsibility to ensure that their network is configured in a secure manner. A User may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A User may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner.

Introducing viruses, Trojan horses, worms, and other types of malicious programs into the WireSpeed network, and thereby the Internet, will be prosecuted to the fullest extent of the law

m. NEWS. WireSpeed Users should use their best judgment when posting to any newsgroup. Many groups have charters, published guidelines, FAQs, or "community standards" describing what is and is not considered appropriate. Usenet can be a valuable resource if used properly. The continued posting of off-topic articles is prohibited. Commercial advertisements are off-topic in most newsgroups, especially regional groups not specifically named for such. The presence of such articles in a group is not indicative of the group's "intended" use. Please familiarize yourself with basic Usenet netiquette before posting to a newsgroup.

WireSpeed Users may not cancel messages other than their own messages. A User may cancel posts forged in that User's name. We may cancel any postings which violate this AUP.

n. MIS-USE OF SERVICES. Using a personal or residential account for commercial use is prohibited. Commercial use is defined as hosting a server of any type using your WireSpeed service (see next section for information about WEB SITE AND SERVER POLICY). The Services are intended for personal use to include: active use of email, newsgroups, file transfers, Internet chat, games, and browsing the World Wide Web. Users may maintain a dialup connection so long as they are actively using that connection for the above purposes. Users may not use the Services on a standby or inactive basis in order to maintain a dialup connection. Accordingly, WireSpeed maintains the right to terminate any User's dialup connection following any extended period of inactivity as determined by WireSpeed.

This Acceptable Use Policy is not meant to be a straightjacket on using WireSpeed networks. By simply conforming to this policy, all users create an environment where communication can flow freely and with a minimum of policing.

DISCLAIMER

The Internet is a network of unrelated telecommunications facilities, computers and computer software that provide for the exchange of information. As such, it is subject to many different points of failure, under the control of no single entity or individual, and cannot be assumed to be available for use at any given moment. It should under no circumstances be relied upon as the only means of communication of important information. Users therefore agree to hold WireSpeed and its subsidiaries, affiliates, related companies, employees, officers, directors and agents harmless in the event of the user's inability to access or communicate via the Internet.

Quote and Billing Agreement

Consumer will pay all invoiced amounts within thirty (30) days of the date of invoice. Customer will advise Wire Speed Telecommunications in writing of any billing discrepancy or dispute within ten (10) days of the date of invoice. All amounts not paid when due will bear interest until paid at a rate of interest equal to the lesser of one and one-half percent (1½%) per month or the maximum rate of interest allowed by applicable law. Wire Speed Telecommunications LLC reserves the right, from time to time, to evaluate Customer's credit standing, and may establish a credit limit to accommodate Customer's request for services hereunder. As the result of Wire Speed Telecommunication’s findings, Wire Speed Telecommunications LLC reserves the right to require reasonable assurances of payment until credit is established to Wire Speed' Telecommunication's satisfaction. Taxes. Customer will pay all applicable taxes, duties and  charges, including interest and penalties, that any governmental or taxing authority may impose upon the purchase, licensure, ownership, possession, use, operation of the Services provided by Wire Speed Telecommunications, LLC under this Agreement,

Governmental Charges.

Wire Speed Telecommunications, LLC may adjust its rates and charges or impose additional rates and charges in order to recover amounts it is required or permitted by governmental order or quasi governmental authorities to collect from or pay to others in support of statutory or regulatory programs (“Governmental Charges”). Examples of such Governmental Charges  include, but are not limited to, Universal Service Funding and Primary Interexchange Carrier Charge cost recovery. This Agreement is subject to, and the parties agree to comply with, all applicable federal, state and local laws, and regulations, rulings, and orders of governmental agencies, including, but not limited to, the Communications Act of 1934, the Telecommunications Act of 1996, the Rules and Regulations of the Federal Communications Commission, and state public utility or service commissions. Customer covenants and agrees that it will not use any Services for any illegal purpose or in any other unlawful manner. In connection with Customer's use of any Services, Wire Speed Telecommunications LLC will not be responsible for the security or confidentiality, nor for the content, correctness or usability, of Customer's data or other information.

Returns and Refunds

Wire Speed Telecommunications, LLC will refund pro rated amounts of monthly service when service is terminated in writing within 12 business days of the end of the month and calls and features have been disabled for all numbers on the account.   Refunds and prorated amounts do not include refunds on support or additional services, federal or state taxes, shipping or handling and other service charges. Accounts terminating prior to their contracted length will be charged the remainder of their contract upon termination in addition to the pro rated "final" charges. 

No returns of any type will be accepted with out an Return Merchandise Authorization (RMA) number. RMA numbers may be requested within 10 days of the original date of merchandise shipment by calling 1-800-WSTELCO or emailing billing(at)wstelco.com.  All items without a RMA number will be refused. A non-defective return will include a $30 handling fee.  Original boxes and manufacturers documentation must be included in "resalable" condition to receive any credit to your account for the return.
